Legal Battle Emerges Between Former Employee and Phoenix Suns

The Phoenix Suns are facing a significant legal challenge as Andrea Trischan, a former program manager of diversity, equity, and inclusion, has filed a lawsuit against the organization. Trischan, who was with the Suns from September 2022 to July 2023, is seeking a staggering $60 million in damages, alleging a series of serious claims, including harassment, racial discrimination, retaliation, and wrongful termination.

Allegations and Legal Proceedings

The lawsuit follows Trischan's claims that were previously dismissed by the U.S. Equal Employment Opportunity Commission and the Arizona Attorney General's civil rights division in November, citing insufficient information. Despite these dismissals, Trischan's lawsuit paints a troubling picture of her experience within the Suns organization.

According to Trischan's attorney, Sheree Wright, her client "endured overt racist comments and a hostile work environment that went unaddressed despite being reported to HR and executive leadership." The lawsuit also draws attention to several executive figures within the Suns. Two individuals mentioned by Trischan, Kyle Pottinger and Melisa Goldenberg, have since departed from the organization. Jason Rowley, who acted as team president and CEO, resigned in February 2023, adding another layer of upheaval to the Suns' leadership during this period.

Amidst these allegations, the organization has firmly denied any wrongdoing. Stacey Mitch, Senior Vice President of Communications for the Suns and the WNBA's Phoenix Mercury, stated, "Her claims have been without merit from Day 1, and now this lawsuit, in which she is seeking $60M, is based on the same claims that were just dismissed. We are fully confident the courts will agree her story is completely fabricated."

The Role of the Diversity Council

The introduction of the diversity council within the Suns was intended to strengthen the organization's commitment to diversity, equity, and inclusion. In a statement, the Suns described the council as "comprised of the entire executive team and other leaders in the organization" and said its purpose is to "listen to the diversity data and information on DE&I initiatives to continue to further the organization's DE&I commitment."

Trischan’s lawsuit ostensibly challenges the effectiveness of this council, casting a spotlight on its role and the allegations that it failed to address significant issues regarding workplace culture and management practices. Her performance led to a placement on a performance improvement plan in late May, shortly before her departure from the organization in July.
